We may ask you to provide your personal information anytime you are in contact with Wholesome Food Services or a company affiliated with Wholesome Food Services. You are not required to provide your personal information, but if you choose not to, we may not be able to provide you with our products or services or respond to your queries.  We and our affiliates may also share your personal information with each other and use it according to this Privacy Policy. We and our affiliates may also combine personal information with other information to provide and improve our products, services, content, and advertising. 

We will use reasonable efforts to comply with all applicable local, state and U.S. federal laws pertaining to personal information we receive from you.

Examples of the types of personal information Wholesome Food Services may collect include, but are not limited to, the following:

When you create an Wholesome Food Services profile for yourself or your child(ren), make purchases on our website or through our mobile app, download a software update, connect to our services, contact us including by social media or participate in a survey, we may collect a variety of information, including your name, the name(s) of your children, mailing address, phone number, email address, contact preferences, device identifiers, IP address, location information, credit card information and profile information where the contact is via social media.  By agreeing to this CUPI, you represent that you are of majority age and are the adult responsible for or have been given permission by the adult responsible for the disclosure of any personal information on a child or any other adult. 

If you send Wholesome Food Services gift certificates and products to others, or invite others to participate in Wholesome Food Services programs, we may collect the information you provide about those people such as their name, mailing address, email address, and phone number. Wholesome Food Services will use such information to fulfill your requests, provide the relevant product or service, or for anti-fraud purposes.

We may process your personal information for the purposes described in this Privacy Policy, with your consent, for compliance with a legal obligation to which Wholesome Food Services is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it necessary for the purposes of the legitimate interests pursued by Wholesome Food Services or a third party to whom it may be necessary to disclose information.

We may use your personal information to notify you of Wholesome Food Services’ latest product announcements, software updates, and aspects of our program. If you don’t want to be on our notification lists, you can opt-out anytime by updating your preferences or by contacting our Customer Support team.

We may use your personal information to create, develop, operate, deliver, and improve our products, services, content and advertising, and for loss prevention and anti-fraud purposes related to the conduct of online transaction(s) with us. We may also use your personal information for account and network security purposes, including the protection of our services for the benefit of all our users.  We may use your personal information, including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. For example, we may use date of birth to determine the age of Wholesome Food Services profile holders.

From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Wholesome Food Services, you may not opt out of receiving these communications.

We may use personal information for internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications.

If you enter a contest or similar promotion we may use the information you provide to administer those programs.

Source of your personal information which is not collected from you

We may have received your personal information from other persons if they shared their content with you using Wholesome Food Services products, sent you gift certificates and products, or invited you to participate in Wholesome Food Services’ programs. We may also validate the information provided by you when creating a Wholesome Food Services profile with a third party for security and fraud prevention purposes.

Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are examples of non-personal information we collect and how we may use it:

We may collect information such as zip code, area code, unique device identifier, referrer URL, location, and the time zone where a Wholesome Food Services product is used so that we can better understand customer behavior and improve our products, services, and advertising.

We may collect information regarding customer activities on our website and from our other products and services. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Cookies and Other Technologies

Wholesome Food Services’ websites, online services, interactive applications, email messages, and advertisements may use “cookies” and other technologies such as pixel tags and web beacons to help us understand user behavior, tell us which parts of our websites people have visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

We may also use cookies and other technologies to remember personal information when you use our website, online services, and applications so that we can make your experience with Wholesome Food Services more convenient and personal. 

We gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data. We use this information to understand and analyze trends, administer the site, learn about user behavior, improve our product and services, and gather demographic information about our overall user base. We may use this information in our marketing and advertising services.

In some of our email messages, we may use a “click-through URL” linked to content on the Wholesome Food Services website or the websites of our affiliates. We may track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages. Pixel tags enable us to send email messages in a format customer can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

Disclosure to Third Parties

At times Wholesome Food Services may provide third parties with certain personal information to provide or improve our products and services, including to deliver products at your request, or to help Wholesome Food Services market to consumers. When we do, we require those third parties to handle that personal information in accordance with relevant laws. 

Disclosure to Our Service Providers

Wholesome Food Services shares personal information with companies who provide services such as information processing, fulfillment of customer orders, product delivery, customer data management and enhancement, customer support, and customer research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever Wholesome Food Services operates.

Disclosure to Legal/Governmental Authorities

We may be required by law, legal process, litigation, and/or requests from local, state or federal governmental authorities to disclose your personal information. We may also disclose information about you, but only where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users.  In the event of a bankruptcy, reorganization, merger, or sale of Wholesome Food Services we may transfer any and all personal information we collect to the relevant third party, without your permission or any compensation being paid to you.

Integrity and Retention of and Access to Personal Information

Wholesome Food Services makes it easy for you to keep your personal information accurate, complete, and current. You maintain the accuracy of your contact information and preferences by signing into your Wholesome Food Services profile. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy and our service specific privacy summaries. 

For other personal information we hold, we will provide you with access (including a copy) for any purpose including to request that we correct the data if it is inaccurate or delete the data if Wholesome Food Services is not required to retain it by law or for legitimate business purposes.

We may decline to process requests that are frivolous, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes as described earlier.

Wholesome Food Services websites, products, applications, and services may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties.  Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. 

Destruction of Data

We maintain a corporate policy in compliance with the prescriptions of C.R.S. 22-16-110 (3) regarding the proper disposal of personal information and notice of destruction to you.

In summary, the policy states if you request the destruction of personal information that we have collected, generated or inferred as a result of this this service, we will destroy all such information within ten (10) business days after we receive your written request with specific instruction, unless we have obtained your consent, or that of your majority aged child, to retain the personal information, or your child has been transferred to another public education entity and the receiving public education entity has requested that we retain the student’s personal information. 

Breach Notification

If we become aware of an incident, misuse of personal information, or unauthorized disclosure involving any personal information, we shall notify you as soon as possible but no later than thirty (30) days after we determine that a breach has occurred and we will cooperate with you regarding recovery, remediation, and the necessity to involve law enforcement, if any.
